Privacy Policy

Meridian Technologies LLC ("Meridian," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the Meridian platform at osmeridian.com (the "Service"). Please read this policy carefully. If you do not agree with its terms, please discontinue use of the Service.

1. Information We Collect

We collect information you provide directly to us, including: account registration information (name, email address, phone number, brokerage name); billing and payment information processed through Stripe; contact and transaction data you enter into the Service; communications you send to us. We also collect information automatically when you use the Service, including: log data (IP address, browser type, pages visited, time spent); device information; cookies and similar tracking technologies; property search and browsing behavior within the IDX search feature. We may receive information from third parties, including MLS data providers, Stripe (payment status), and authentication providers such as Google when you use OAuth sign-in.

1b. MLS Listing Data

Meridian accesses MLS listing data through licensed API connections with authorized Multiple Listing Services. This data is retrieved in real time for display purposes and is not permanently stored in our databases. We comply with all applicable MLS IDX and VOW display rules, attribution requirements, and data licensing terms. MLS data is refreshed according to the data feed provider's specified intervals. Listing information is deemed reliable but not guaranteed.

2. How We Use Your Information

We use the information we collect to: provide, maintain, and improve the Service; process transactions and send billing-related communications; send transactional emails and notifications related to your account; operate the automated drip email sequences you configure; generate RESPA-compliant audit logs for co-marketing arrangements; provide customer support; monitor and analyze usage patterns to improve the Service; detect, prevent, and address fraud and security issues; comply with legal obligations.

3. Contact and Transaction Data

The contacts, transactions, and client data you enter into Meridian are your data. We process this data solely to provide the Service to you. We do not sell, share, or use your client data for our own marketing or business purposes. We maintain appropriate technical and organizational safeguards to protect this data. You are responsible for ensuring you have appropriate legal basis for processing your clients' personal information through the Service.

4. TCPA Consent Records

When you collect and store SMS consent records through the Service, we store those records on your behalf as part of the Service. These records are associated with your account and are accessible to you. We retain these records for the duration of your subscription and for up to 5 years following termination, to assist you in demonstrating compliance with TCPA requirements.

5. Sharing of Information

We do not sell your personal information. We may share your information with: service providers who assist us in operating the Service (Stripe for payments, Resend for email, Twilio for SMS, Lob for direct mail, Supabase for database hosting, Vercel for hosting, Inngest for job processing); MLS data providers to enable IDX search functionality; law enforcement or government agencies when required by law; successor entities in the event of a merger, acquisition, or sale of assets. All service providers are contractually required to use your information only as necessary to provide services to us and in accordance with applicable law.

6. Cookies and Tracking

We use cookies and similar technologies to maintain your session, remember your preferences, and analyze usage of the Service. We use Supabase authentication cookies that are strictly necessary for the Service to function. We do not use third-party advertising cookies or sell your browsing data to advertisers. You can control cookies through your browser settings, but disabling cookies may affect the functionality of the Service.

7. Data Security

We implement industry-standard security measures to protect your information, including: TLS encryption for data in transit; encrypted storage for sensitive data; row-level security in our database to ensure tenant data isolation; signed URLs with 15-minute expiry for document access; multi-factor authentication support; regular security monitoring and logging. No security measure is perfect. In the event of a data breach that affects your personal information, we will notify you as required by applicable law.

8. Data Retention

We retain your account information for as long as your account is active. Following account termination, we may retain your data for up to 90 days to allow for account recovery, after which it is permanently deleted. TCPA consent records are retained for 5 years as described above. Billing records are retained as required by applicable tax and accounting laws.

9. Your Rights

Depending on your location, you may have certain rights regarding your personal information, including the right to access, correct, or delete your personal information; the right to object to or restrict certain processing; the right to data portability; and the right to withdraw consent where processing is based on consent. To exercise these rights, contact us at legal@osmeridian.com. We will respond to your request within 30 days. We may require verification of your identity before processing certain requests.

10. Children's Privacy

The Service is not directed to children under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child without parental consent, we will take steps to delete that information.

11. California Privacy Rights

California residents have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including the right to know what personal information we collect and how it is used, the right to delete personal information, the right to opt out of the sale of personal information (we do not sell personal information), and the right to non-discrimination for exercising privacy rights. 12. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by email or by posting a notice within the Service. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised policy.
